Coming Soon: OSHA COVID-19 Emergency Temporary Standard

Employers should prepare to comply quickly with new workplace rules from the Occupational Safety and Health Administration (OSHA), which could address employee training, masks, social distancing, cleaning and disinfection, and other safety measures. This week, OSHA sent a COVID-19 emergency temporary standard to the Office of Management and Budget (OMB) for review. 

President Biden previously issued Executive Order 13999 directing OSHA to determine whether an emergency temporary standard is necessary to protect workers from COVID-19 exposure and risks – and if OSHA determined a standard was necessary – to issue it by March 15. Shortly before March 15, OSHA informed multiple business groups that it had decided to issue a standard but needed more time.

Since then, OSHA has been under increased pressure from Congress and many worker protection groups to issue an emergency temporary standard to mitigate the spread of COVID-19 in the workplace.

The specific language of the emergency temporary standard and when OMB will complete its review is unknown. OMB can take as much time as necessary for the review. Although, many reports suggest the review period will be approximately two weeks. Upon publication in the Federal Register, the standard takes effect immediately. The standard will be effective for six months or until a permanent standard is adopted following the regular rulemaking process.

Kentucky COVID-19 Safe Workplace Training Update

On April 19, 2021, Kentucky Governor Andy Besher issued new Kentucky Healthy at Work: Minimum Requirements for All Entities, which eases certain business restrictions.

Pursuant to the new Minimum Requirements, businesses are no longer required to create a testing plan, designate a Healthy-at-Work officer, train employees on various safe work practices, or mandate telework.

Businesses are still required to abide by social distancing requirements, provide hand sanitizer, clean high-contact areas, and assist public health officials.

Face coverings are still required by Executive Order.

Michigan COVID-19 Safe Workplace Training Update

On April 12, 2021, Michigan Governor Gretchen Whitmer announced that the Michigan Occupational Safety and Health Administration (MIOSHA) would extend the state’s COVID-19 emergency rules, which expire on April 14, 2021, for six (6) more months.

New Hampshire COVID-19 Safe Workplace Training Update

New Hampshire Governor Chris Sununu announced the state’s mask mandate expired on April 16, 2021. The Governor does not plan to renew the mask mandate at this time.

Alabama COVID-19 Safe Workplace Training Update

Alabama’s face mask mandate expired on April 9, 2021. Under the state’s Safer Apart Order issued on April 7, employers are now encouraged to take reasonable steps to protect employees, such as the use of the face masks.

Utah COVID-19 Safe Workplace Training Update

Utah Governor Spencer Cox signed HB 294, which ended the state’s face mask mandate on April 10, 2021.

The Utah Labor Commissioner’s Emergency Rules requiring employees to wear face masks in the workplace expired the day before, on April 9, 2021.

HB 294 states that the Utah Department of Health may issue a public health mask order if it only applies to a gathering of 50 or more people unable to maintain physical distancing of at least six (6) feet.

Colorado COVID-19 Safe Workplace Training Update

On April 3, 2021, Colorado Governor Jared Polis issued Executive Order D 2021 079, which amends the state’s face mask mandate.

Masks are now only required in counties with one-week disease incidence rates over 35 per 100,000 – which are known in Dial 3.0 as blue, yellow, orange, red, and purple counties – when entering or within public indoor spaces where 10 or more unvaccinated individuals or individuals of unknown vaccination status are present.

The Order also requires masks in a variety of other public and private settings, such as personal services and limited healthcare settings.
